Targeting of Suspected Terrorists – Extra-judicial Executions or Legitimate Means of Defense

Kretzmer compares two competing models of law, that of law-enforcement and that of armed conflict, and examines their application in targeting suspected terrorists. Kretzmer discusses whether there is a category of persons in the armed conflict model which may be legitimately labeled “unlawful combatants” when a civilian participates directly in hostilities. He asks how the existence of alternatives influences the issue.
