Dworkin examines the interplay between two legal/normative regimes – international humanitarian law and human rights – in order to work toward a set of rules governing military campaigns against terrorist groups that is more limiting and more in keeping with humanitarian values than current US procedures. Dworkin argues that the so-called “war on terror” – even if it rises to the level of war – doesn’t “authorize” Guantanamo or other prerogatives that the Bush administration claims.
